These Terms of Service (“Terms”) govern your use of LINK EMOTO’s website, track directory, rider community, related pages, content, features, and services (collectively, the “Services”).
The website is operated by LINK EMOTO (“LINK EMOTO,” “we,” “us,” or “our”) and is hosted through Shopify. The LINK EMOTO Rider Network is currently provided through a separate Discourse community.
By accessing or using the Services, you agree to these Terms, our Privacy Policy, Track Information Disclaimer, and Community Guidelines. If you do not agree, do not use the Services.
1. Eligibility
You must be legally capable of agreeing to these Terms in your jurisdiction.
If you are under the age of majority, you may use the Services only with the permission and supervision of a parent or legal guardian. Parents and guardians are responsible for a minor’s use of the Services.
2. Purpose of the Services
LINK EMOTO provides resources intended to help electric-moto riders:

Discover tracks and riding facilities

Share and correct track information
-
Discuss motorcycles, builds, equipment, maintenance, and riding

Connect with other riders
-
Organize independent meetups and group rides
-
Learn about events and the electric-moto community
The Services are informational and community-based. Unless explicitly stated otherwise, LINK EMOTO does not own, operate, inspect, manage, certify, or supervise any listed track, riding location, meetup, group ride, event, business, product, or service.
3. Accounts and Community Access
Some features may require an account with Shopify, Discourse, or another service provider.
You agree to:

Provide accurate and current information

Protect your login credentials

Accept responsibility for activity performed through your account

Notify the applicable platform if you believe your account has been compromised

Avoid transferring, selling, or sharing your account without permission
Access to the LINK EMOTO website does not automatically create an account on the LINK EMOTO Rider Network. Discourse accounts and activity may also be governed by Discourse’s applicable terms and privacy policies.
We may restrict, suspend, or terminate access when reasonably necessary to protect the community, enforce these Terms, or comply with law.
4. Track and Riding Information
Track listings, access policies, hours, prices, riding conditions, permitted motorcycles, safety requirements, waiver requirements, and other details can change without notice.
LINK EMOTO does not guarantee that directory information is accurate, complete, current, or suitable for your particular motorcycle or intended activity.
Before traveling or riding, you must contact the track or property operator directly to confirm:

Whether your specific e-moto is permitted

Current hours and fees

Available riding areas

Closures and track conditions
-
Required waivers or reservations

Age and skill restrictions
-
Required protective equipment
-
All other applicable rules
A listing or “Verified” designation reflects only the information reasonably available when it was reviewed. It is not a guarantee of continuing access, safety, quality, or approval for every e-moto.

5. Riding Risks
Electric-moto, motorcycle, motocross, trail, and off-road activities are inherently dangerous.
Potential risks include collisions, falls, changing terrain, equipment failure, battery or electrical failure, fire, weather, obstacles, other riders, vehicles, property damage, serious injury, permanent disability, and death.
You are solely responsible for deciding whether to participate, evaluating your equipment and abilities, wearing appropriate protective equipment, obeying applicable laws and property rules, and accepting the risks involved.
Nothing published through the Services constitutes professional safety, legal, mechanical, medical, or emergency advice.
6. Rider Meetups and Group Rides
Members may use the Services to discuss or organize meetups, group rides, and other activities.
Unless LINK EMOTO expressly states in writing that it is the organizer, these activities are independently organized by their participants. LINK EMOTO does not:

Supervise or control the activity

Inspect the meeting location

Verify rider qualifications or identities

Conduct background checks
-
Provide transportation
-
Guarantee attendance or participant conduct

Supply insurance, medical services, or emergency assistance
Participation is voluntary and at your own risk. Exercise reasonable caution when meeting people you first encountered online.
Minors should attend only with the knowledge and supervision of a parent or legal guardian.
7. Acceptable Use
You may not use the Services to:

Violate any law, regulation, track rule, or property restriction

Promote trespassing or unauthorized riding

Organize dangerous or illegal street activity

Harass, threaten, intimidate, or impersonate another person

Publish another person’s private information without permission
-
Distribute spam, scams, malicious code, or deceptive links

Infringe intellectual-property or privacy rights
-
Misrepresent track access or safety information
-
Interfere with the operation or security of the Services

Scrape, copy, or commercially exploit the directory or website without written permission

Create accounts or use automation to evade moderation
-
Use the Services for an unlawful, fraudulent, or harmful purpose
Users must also follow our Community Guidelines.
8. User Content
“User Content” includes information, text, photographs, videos, track reports, reviews, corrections, messages, and other materials submitted through the Services.
You retain ownership of your User Content. By submitting it, you grant LINK EMOTO a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, display, distribute, and use that content as reasonably necessary to operate, promote, moderate, and improve the Services.
This license includes permission to incorporate submitted track information and corrections into the LINK EMOTO directory.
You represent that:

You own the content or have permission to submit it

The content does not violate another person’s rights

The information is not intentionally false or misleading

Publishing the content will not violate applicable law
Do not submit confidential information or content you do not want displayed publicly.
We may edit, move, refuse, or remove User Content, but we are not obligated to monitor every submission.
9. Community Moderation
LINK EMOTO may establish and enforce reasonable community and moderation rules.
We may warn users, remove content, limit features, close discussions, suspend accounts, or permanently prohibit access when reasonably necessary to:

Enforce these Terms or Community Guidelines

Address illegal, abusive, deceptive, or dangerous conduct

Protect users, tracks, businesses, or the public

Preserve the integrity and security of the Services

Comply with legal obligations
Moderation decisions may consider severity, context, previous conduct, and potential harm.
10. Third-Party Services and Links
The Services may link to Shopify, Discourse, maps, social networks, track websites, event organizers, waiver providers, manufacturers, retailers, and other third parties.
LINK EMOTO does not control these third parties and is not responsible for their content, policies, availability, security, products, services, or conduct.
A link, listing, logo, mention, or “Verified” designation does not automatically mean LINK EMOTO endorses, sponsors, certifies, or has a business relationship with that third party.
Your use of third-party services is governed by their own terms and policies.
11. Sponsorships and Advertising
LINK EMOTO may offer advertising, sponsorships, featured listings, affiliate relationships, or other commercial opportunities in the future.
Paid relationships will be identified when required by law. Payment for advertising or enhanced placement will not constitute a safety certification or guarantee of track access, quality, or suitability.
Editorial and verification standards may be applied independently from advertising relationships.
12. Future Products and Paid Services
LINK EMOTO may offer merchandise, event registration, memberships, digital services, parts, gear, or other products and services in the future.
Additional terms, prices, refund rules, waivers, or purchase conditions may apply to those offerings. If additional terms conflict with these Terms, the more specific terms will control for that transaction or activity.
Displaying a future product or service does not guarantee availability.
13. Intellectual Property
The Services, including LINK EMOTO’s name, logos, directory design, original text, graphics, website design, and other original materials, are owned by LINK EMOTO or used with permission and are protected by applicable intellectual-property laws.
You may use the Services for personal, noncommercial purposes. You may not reproduce, republish, sell, license, systematically extract, or commercially exploit LINK EMOTO materials without written permission.
Third-party names, logos, trademarks, photographs, and content remain the property of their respective owners.
14. Copyright Complaints
If you believe content available through the Services infringes your copyright or other intellectual-property rights, contact LINK EMOTO through the Contact page and provide:

Identification of the protected work

Identification and location of the disputed content

Your contact information

A statement explaining your good-faith belief that the use is unauthorized

A statement that the information you provided is accurate

Your physical or electronic signature
We may remove disputed content while reviewing a complaint.
15. Privacy
Our collection and use of personal information are described in our Privacy Policy.
Information submitted directly to Discourse, Shopify, or another third-party service may also be processed under that provider’s privacy policy.
Forum posts and profile information may be publicly visible and indexed by search engines. Do not publish sensitive personal information through public community areas.
16. Service Availability and Changes
We may modify, suspend, discontinue, or restrict any portion of the Services at any time.
We do not guarantee that the Services will always be available, uninterrupted, secure, accurate, or error-free. We are not responsible for delays or failures caused by hosting providers, internet services, third-party platforms, maintenance, security incidents, or events outside our reasonable control.
17. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL INFORMATION MADE AVAILABLE THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
LINK EMOTO DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SAFETY, AVAILABILITY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT A TRACK WILL ADMIT YOU, THAT A LOCATION IS SAFE, THAT INFORMATION WILL REMAIN CURRENT, OR THAT ANOTHER MEMBER WILL BEHAVE AS EXPECTED.
Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LINK EMOTO AND ITS OWNERS, AFFILIATES, CONTRIBUTORS, CONTRACTORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO:

Your use of or inability to use the Services

Reliance on directory or community information

Travel to or denial of access at a riding location

Participation in riding, meetups, group rides, or events

Interactions or transactions with other users or third parties

Loss of data, content, revenue, opportunity, or reputation

Injury, death, property damage, equipment failure, or other loss connected with riding activities
Nothing in these Terms excludes liability that cannot legally be excluded.
19. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless LINK EMOTO and its owners, affiliates, representatives, contractors, and service providers from claims, liabilities, losses, damages, and reasonable expenses arising from:

Your violation of these Terms

Your User Content

Your violation of another person’s rights

Your unlawful or unauthorized conduct

An activity or meetup you organize

Your use of a listed track or riding location
20. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute that is not subject to a separately agreed dispute-resolution process will be handled in a court with appropriate jurisdiction in Texas, except where applicable consumer law requires otherwise.
21. Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver of our right to enforce it later.
22. Changes to These Terms
We may update these Terms as the Services develop. The updated version will be posted on this page with a revised “Last updated” date.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
